Injury Law Center Obtains Settlement in Accidental Shooting Case
Injury Law Center recently obtained a settlement of $150,000 for a minor who was accidentally shot in the elbow with a .22 caliber firearm. The settlement was approved by the Worcester Superior Court in Worcester, MA.
According to Attorney Joe Russo , the young man was shot by someone “who had no concept of gun safety” and who was “completely inept at handling firearms.” The loaded weapons had been supplied by adults to shoot target practice without supervision during a trip to Maine.
A parent himself, Attorney Russo remarked: “this is what got me the most, the trip organizer never even told the young man’s parents that he was bringing guns on the trip. This is the definition of irresponsibility.”
Attorney Russo brought negligent entrustment of a firearm and negligent supervision civil claims against the adult defendant who organized the trip and supplied the guns. The Injury Law Center team consulted with the Brady Center to Prevent Gun Violence to determine whether any laws were violated by transferring a gun to a minor. It was found that the adult defendant did violate both Massachusetts and Maine laws because he never obtained the minor parent’s consent before giving him the weapon (M.G.L. 140 § 130; M.G.L. 140 § 1301/2; Maine Criminal Code Title 17-A §554-B).
The individual who shot the plaintiff was prosecuted by the Somerset County District Attorney’s Office in Maine and was convicted of misdemeanor Reckless Conduct.
