$250,000 Settlement Recently Secured for Patient With RSD / CRPS
The Injury Law Center is happy to report that they recently secured a $250,000 settlement at mediation one month before trial on behalf of a hardworking delivery driver who sustained an ankle fracture which subsequently developed into Reflex Sympathetic Dystrophy (RSD)/Complex Regional Pain Syndrome (CRPS).
Attorney Russo explained “this case was a resounding success for our deserving client who suffers from a very rare and painful condition known as RSD/CRPS. This young man was involved in a highway collision caused by a commercial truck which merged into his lane without signaling or checking his side view mirror. Our client struck the jersey barrier at a high rate of speed and broke his ankle in several places.”
Attorney Russo described RSD/CRPS as follows “the sympathetic nervous system regulates the body’s automatic response to trauma. For example, if a patient sustains a fractured ankle, the ankle is going to swell, bruise, and become hypersensitive. Typically, these symptoms subdue when the fracture heals. However with RSD/CRPS, the sympathetic nervous system is re-activated and placed on a loop so the symptoms are re-experienced long after healing. If RSD/CRPS is not aggressively treated in the initial stages, the pain will become permanent. This is exactly what happened in this case.”
Attorney Russo went into more detail “what made this case so challenging is that our client continued to work and if he walked into the court room, you would think there was nothing wrong with him. But in actuality, his foot was burning with pain. We hired a decorated pain management specialist to explain the condition. We also invested in having a custom animation put together as an exhibit to be used at trial. We were very pleased that we were able to leverage a great settlement number in this case.”
